Terms and Conditions for Gardeners Wallington
These Terms and Conditions set out the basis on which gardening and grounds maintenance services are provided by Gardeners Wallington. They apply to all bookings, whether the work involves routine lawn care, hedge trimming, planting, clearance, seasonal tidy-ups, or other agreed garden services. By requesting a booking, you agree to be bound by these terms. If any part of these Terms and Conditions is unclear, the customer should review them carefully before confirming an appointment. These terms are intended to provide a fair and practical framework for both the customer and the service provider.
For the purposes of this document, the terms “we,” “us,” and “our” refer to the gardening service provider, and “you” or “the customer” refers to the person, business, or property owner requesting the service. The scope of work may vary depending on the nature of the garden, the time required, weather conditions, access arrangements, and any special requirements discussed before the appointment. Any additional work not originally agreed may be treated as a separate service and may be priced accordingly.
These terms are designed to support a clear booking process, straightforward payment expectations, and responsible working practices. They also explain the limits of liability, how cancellations are handled, and how waste from garden work is managed in line with applicable UK rules. Nothing in these Terms and Conditions affects your statutory rights as a consumer where those rights cannot lawfully be excluded or limited.
Booking Process
A booking is only confirmed when the requested service has been accepted and a date, time, and general scope of work have been agreed. During the booking process, you may be asked to provide details about the garden, including the type of work needed, size of the area, access points, known hazards, parking restrictions, and any relevant instructions. This helps ensure that the garden service is delivered efficiently and safely. If the information provided is inaccurate or incomplete, the quoted price or appointment timing may need to be revised.
We reserve the right to decline a booking if the work is unsuitable, unsafe, beyond our capacity, or outside the normal services offered by Gardeners Wallington. In some cases, a site visit may be required before confirming the appointment, particularly where the work is extensive, overgrown, or likely to require specialist equipment. Any estimate given before the visit is based on the details provided and may change if the actual conditions differ materially from those described.
Customers must ensure that access to the property is available at the agreed time. If locked gates, restricted entry, aggressive animals, or other access problems prevent us from carrying out the work, the appointment may be treated as a late cancellation or a failed visit. You are also responsible for informing us of any underground services, fragile structures, hidden obstructions, or protected features that may affect the safe completion of the service. We will take reasonable care, but we cannot be responsible for risks not disclosed to us in advance.
Payments and Pricing
Prices will usually be agreed in advance, either as a fixed fee or as an estimated hourly or day rate depending on the type of gardening service required. Any quotation is based on the information available at the time and may exclude unforeseen issues such as excessive waste, difficult access, severe neglect, or hidden hazards. If it becomes clear that additional time or materials are needed, we will discuss the revised cost with you before continuing wherever reasonably practicable.
Payment terms will be confirmed at the time of booking. Unless otherwise agreed, payment is due on completion of the work on the same day. For larger projects or repeat garden maintenance arrangements, we may request a deposit or staged payments. If a deposit is required, your booking may not be secured until that payment is received. All deposits are applied against the final invoice unless expressly stated otherwise in writing.
We accept payment by the methods agreed at booking. If payment is not received when due, we may suspend further services, refuse future bookings, or recover any outstanding sums through lawful means. Where an invoice remains unpaid, reasonable administration costs and any lawful late-payment charges may be added. You are responsible for ensuring that sufficient funds are available and that any bank transfer, card payment, or other payment method is completed accurately.
Changes to the Agreed Price
Occasionally, the scope of work may change once the service begins. For example, a hedge may prove larger than expected, a lawn may require multiple passes, or a clearance job may generate more waste than originally anticipated. If this happens, we will aim to notify you before incurring extra charges. If the customer requests additional gardening work during the visit, that work will be charged separately at the applicable rate.
Cancellations and Rescheduling
Customers may cancel or rearrange a booking, but reasonable notice should be provided. Unless otherwise agreed, any cancellation made with less than 24 hours’ notice may be charged in part or in full, especially where time has been reserved and materials or staff have already been allocated. Where a deposit has been taken, the deposit may be retained to cover lost time and administrative costs if the cancellation is late or unreasonable.
If weather conditions make it unsafe or impractical to carry out the service, we may postpone or reschedule the appointment. Gardening work is often affected by rain, frost, high winds, or other adverse conditions. We will act reasonably in deciding whether to proceed, and any decision to delay work will be made with safety and quality in mind. Where possible, we will offer an alternative time or date.
We may also cancel or postpone a booking if there is a serious issue affecting safety, access, staff availability, or equipment failure. In such cases, we will attempt to notify you as soon as reasonably possible. If we cancel for reasons within our control, any prepaid amount for work not carried out will normally be refunded or credited, unless another arrangement is agreed. No compensation will be payable for inconvenience caused by circumstances beyond our reasonable control.
Service Standards and Customer Responsibilities
We aim to provide a professional gardening service with reasonable skill and care. However, outcomes can vary depending on the condition of the property, the season, and the type of work requested. Some tasks, such as restoring neglected areas, may require multiple visits before improvement is fully achieved. Unless specifically agreed in writing, we do not guarantee a particular aesthetic result, plant survival rate, or long-term maintenance outcome.
You are responsible for removing or securing personal items, fragile ornaments, toys, pet accessories, or other movable objects before work begins. If such items are left in the work area, we may move them only if it is reasonably safe to do so, but we are not responsible for damage resulting from the presence of obstacles. Any instructions relating to plants to be preserved, borders to be avoided, or areas that should not be entered must be communicated clearly before the service starts.
Where the service includes the use of tools, machinery, or chemicals, the customer must not interfere with equipment or instruct staff to use materials in a way that is unsafe or contrary to normal working practice. We reserve the right to stop work if the site becomes unsafe, if abusive behaviour occurs, or if the customer requests work that is unlawful or likely to cause damage. In such circumstances, payment may still be due for work already completed.
Plants, Turf, and Seasonal Work
Natural materials are subject to variation. Seeds, turf, soil, fertiliser, bark, and planting stock may differ in appearance and performance from one season to another. We will use reasonable care when selecting and handling materials, but we cannot guarantee exact colour match, growth rate, or weather resistance. For any gardening task involving living plants, the customer accepts that local conditions, water availability, and prior garden condition may affect results.
Liability and Limitations
We will not be liable for loss or damage caused by inaccurate information provided by the customer, hidden defects, wear and tear, pre-existing damage, or circumstances outside our reasonable control. This includes, for example, damage to underground pipes, cables, irrigation systems, fragile paving, or concealed structures where their presence was not disclosed and could not reasonably have been identified. It also includes issues arising from the condition of plants, lawns, or soil before work began.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law. Subject to that, our total liability for any claim arising from a booking, whether in contract, tort, or otherwise, shall be limited to the amount paid for the relevant service, unless a different limit is required by law.
We are not responsible for indirect or consequential losses, including loss of enjoyment, loss of use, loss of profit, business interruption, or consequential property damage, unless such liability cannot lawfully be excluded. Customers should ensure that they have adequate insurance in place for their own property if required. Any claim relating to the service should be made promptly so that the issue can be assessed while relevant information remains available.
Waste Regulations and Site Clearance
Garden waste created during the service will be handled in accordance with applicable UK waste regulations. We aim to dispose of green waste responsibly, including through recycling, composting, or licensed disposal routes where appropriate. If waste removal is included in the service, this will normally cover standard garden waste such as grass cuttings, branches, leaves, weeds, and similar organic material, subject to the limits agreed at booking.
The customer must inform us if waste includes items that are not ordinary green waste, such as soil in large quantities, broken garden furniture, building debris, hazardous materials, contaminated bags, electrical items, or materials requiring specialist handling. Such items may not be accepted as part of a normal gardening service and may incur extra charges or require separate disposal arrangements. We reserve the right to refuse to remove items that are illegal, unsafe, or unsuitable for standard garden waste disposal.
Where waste is taken away by us, ownership of that waste passes to us only once it has been loaded for lawful disposal and only to the extent permitted by law. The customer remains responsible for ensuring that the waste presented for removal is accurate, lawfully placed, and not mixed with prohibited material. If a customer asks for waste to be left in a specific location on the property, they are responsible for any consequences of that request, including compliance with local waste or nuisance rules.
We may ask the customer to retain evidence of any waste transfer or disposal where needed for compliance purposes. If a waste transfer note, receipt, or equivalent record is required for the work performed, reasonable cooperation from the customer may be requested. We will not knowingly breach waste handling requirements, and all waste-related activities will be carried out in line with applicable legislation and reasonable industry practice.
Complaints, Force Majeure, and General Provisions
We aim to resolve concerns fairly and promptly. If you are dissatisfied with any part of the service, you should raise the issue as soon as reasonably possible after the work has been completed. This allows us to review the matter, inspect the relevant area if necessary, and consider whether any corrective action is appropriate. Delayed complaints may be harder to investigate, especially where weather, growth, or further use of the garden has changed the original condition.
We will not be in breach of these Terms and Conditions where failure or delay results from events beyond our reasonable control, including severe weather, accidents, fire, flood, epidemic, shortage of materials, transport disruption, or acts of third parties. In such cases, our obligations may be suspended for the duration of the event. If the disruption continues for a significant period, either party may be entitled to reschedule or terminate the affected booking on reasonable notice.
If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in full force and effect. A failure by us to enforce any right or provision shall not constitute a waiver of that right. These terms represent the entire agreement between the parties regarding the relevant service unless a separate written agreement states otherwise.
Governing Law
These Terms and Conditions, and any dispute or claim arising from them or the services provided under them, shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except where consumer law requires otherwise. By booking with Gardeners Wallington, you acknowledge that you have read, understood, and agreed to these terms as the basis for the service relationship.
